Legislation and Subordinate Legislation Both the Commonwealth and State Governments regulate agricultural and veterinary chemicals in Tasmania. The Commonwealth regulates up to the point of sale under the Agricultural and Veterinary Chemicals Code Act 1994 and associated regulations. This is administered by the Australian Pesticides and Veterinary Medicines Authority (APVMA) who is the statutory authority established to assess, register and control the supply of agricultural and veterinary chemicals through a National Registration Scheme. The Agricultural and Veterinary Chemicals (Control of Use) Act 1995 is the State legislation controlling the use of agricultural and veterinary chemicals. It is supported by a range of subordinate legislation all of which is administered by the Chemical Management Branch within the Biosecurity and Product Integrity Division of the Department and can be found on the Tasmanian Legislation website: www.thelaw.tas.gov.au Tasmania has recently proposed some amendments to the laws controlling the use of agricultural chemical products. These amendments were expected to come into force on 1 April, 2012.
However, the Minister for Primary Industries and Water has decided to defer the regulatory reform process to allow time for further consideration of the proposed amendments prior to their deliberation in Parliament.
Consequently, the existing regulatory requirements will remain in force.
