Sustainable Use of Water Resources

Under Section 8(1)(b) of Tasmania’s Water Management Act 1999 (WMA) a function of the Minister is to develop and coordinate policies relating to the sustainable use and development of Tasmania’s water resources.

Guidelines have been developed to provide the Department of Primary Industries and Water with guidance when exercising discretionary powers under the Water Management Act 1999 for issuing new water allocations from watercourses during winter. This includes water allocations for dams and transfers of water allocations within a catchment.

The guidelines only apply during the winter period because, for the vast majority of streams in Tasmania, no further applications for taking water during summer are being made as these streams are considered fully allocated.

Content of Guidelines

The purpose of these guidelines is to provide a clear, consistent and equitable approach for the granting of new winter water allocations while protecting the health of the State’s rivers and estuaries and the rights of existing users.

The policy includes guidelines on the following:
  • Assessment of applications for new water allocations from watercourses as specified in Part 6 of the Water Management Act 1999.

  • Water allocations made to dams under Part 8 of the Water Management Act 1999. Under Section 159(7) of the Act, a dam permit does not take effect until a new water licence or a variation to an existing licence to take water has been granted.
The guidelines provide an overview about the type of information that applicants may be requested to provide by DPIW to support their application.

Review of Guidelines

Section 6 of the Guidelines requires that the guidelines be reviewed within 12 months of formalisation under the Water Management Act 1999.

The attached review report (July 2004) concludes that since the formalisation of the Guidelines there has been improved consistency and transparency of decision making in regards to applications for new water allocations.
