The Crown Lands Act Review Project (CLARP)

The Department of Primary Industries and Water is reviewing the Crown Lands Act 1976

Foreshore views from Crown land

Public comment on the Issues Paper was invited by 18 May 2009

The Crown Lands Act Review Project (CLARP) has been established to develop a legislative framework that will ensure that Crown lands are managed for the benefit of the Tasmanian community. New legislation will be designed to meet the various responsibilities of Government in relation to Crown land, including protection of the environment and, where appropriate, facilitation of development and ensuring public access and enjoyment of public areas.

Issues Paper

In April 2009 the Department released an Issues Paper for public comment. The Issues Paper is the first phase of public consultation. General comments were invited - on issues with the current arrangements, what you think new arrangements should look like, and more specific comment on the questions posed in the Issues Paper. Comments were to be provided to the Department by Monday 18 of May 2009. (Address details below.)

Why review the Crown Lands Act?

The Crown Lands Act 1976 is now over 30 years old and was written for a different set of circumstances and a different environment than exists today. Today there is a much greater sense of meeting public and community needs, with public land being viewed as an asset for the public benefit and enjoyment of future generations.

The existing legislation does not provide a policy framework to enable strategic and pro-active management of public land in Tasmania.

Over the past 30 years, other changes have occurred in Government administration with a general recognition that the public sector should meet the public demand for open, accountable and transparent decision making within Government agencies. The new act will also aim to improve delivery of Government services by reducing red tape and allowing the streamlining of administrative processes.

Project outcomes

The project will review the Crown Lands Act 1976 and prepare new legislation for the administration and management of Crown land in Tasmania. New legislation will seek to deliver:
  • Sustainable management of public land
  • More consistent and transparent decision making in relation to public land
  • Economic returns for private or commercial use of public land
  • Maximum public use and enjoyment of Crown land.

How you can be involved

CLARP will be open and transparent and there will be a collaborative approach with State Government agencies and consultation with local government, major interest groups and the broader community. It will involve widespread consultation with many organisations representing diverse interests from around the state as well as with interested individuals.

Project staff will ensure interested parties are kept informed of the progress of the project through this website.
