Legislation Compliance Policy

2011

The Department is responsible for the administration of legislation that regulates the sustainable use and development of Tasmania's natural resources for the benefit of all Tasmanians.

Whilst industry and citizens are responsible for ensuring they comply with the law, the Department is dedicated to facilitating, assisting and enforcing adherence to the laws of Tasmania that we are bound by and administer.

The majority of department officers are involved, to some extent, in compliance activities and law enforcement. This ranges from education and creating awareness, assisting industry, partnerships and monitoring to non-formal and formal enforcement through investigations, statutory warnings, infringement notices and prosecution.

The following updated Legislation Compliance Policy sets out the broad approach of the Department in complying with and seeking compliance with the legislation that we administer. The general process for dealing with suspected non-compliance and taking enforcement action are detailed in the Policy. As the Policy is implemented across our Agency, more specific compliance policies will be developed for individual pieces of legislation, or for groups of legislation that seek to achieve similar policy outcomes. Some of these legislation-specific policies may be published on this website where appropriate.

I hope that you find the Legislation Compliance Policy useful in providing guidance on the Department's compliance and enforcement programs.

Kim Evans
SECRETARY
